Decree No. 70/2025/ND-CP of the Government (effective from 01/06/2025) amending and supplementing Clauses 1 and 2, Article 9 of Decree 123/2020/ND-CP on the time of invoicing as follows:

• The time of invoicing for the sale of goods (including the sale and transfer of public assets and the sale of national reserve goods) is the time of transfer of ownership or use of goods to buyers, regardless of whether money has been collected or not.
• For the export of goods (including export processing), the time of issuance of e-commerce invoices, e-VAT invoices or e-sale invoices shall be determined by the seller himself/herself, but not later than the next working day from the date on which the goods are cleared from customs in accordance with the law on customs.
• The time of invoicing for the provision of services is the time of completion of the provision of services (including the provision of services to foreign organizations and individuals), regardless of whether money has been collected or not yet.
• In case the service provider collects money before or during the provision of services, the time of invoicing is the time of collection of money (excluding the case of collecting deposits or advances to ensure the performance of contracts for provision of services: Accounting, auditing, financial and tax consulting; price appraisal; surveying and technical design; supervision consultancy; formulation of construction investment projects).

In addition, Decree 70/2025/ND-CP amends and supplements Points a, e, l, m, n, Clause 4, Article 9 of Decree 123/2020/ND-CP on the time of invoicing for a number of specific cases such as: Selling goods, providing services in large quantities, arising frequently, it is necessary to have time to compare data between enterprises selling goods, etc  providing services and customers, for; (Point a); Activities of prospecting, exploration and exploitation and processing of crude oil (Point b), Lending activities, foreign currency exchange agent activities, provision of foreign currency receipt and payment services of economic organizations of credit institutions (Point l), etc.
