On 17 September 2024, the General Department of Taxation issued Official Letter No. 4102/TCT-CS guiding the tax on the funded fund as follows:
The current CIT law only stipulates that tax-exempt income is a grant received to be used for education, scientific research, culture, art, charity, humanitarian and other social activities in Vietnam. Therefore, the funding that the Company receives from USAID (in the form of standard certifications for the Company’s products and factories) is not intended for use for the purposes mentioned above, so it is not eligible for tax exemption. This sponsorship is another income as prescribed in Clause 15, Article 7 of Circular No. 78/2014/TT-BTC dated 18 June 2014, which is an intangible fixed asset and the Company is obliged to declare, account and pay CIT for this sponsorship according to regulations.
